Terms and Conditions

1. Contract

1.1. Seller – AI & LA Design Ltd. sales site of design goods https://balticdesignstories.eu, further in the text Shop, and the owner of the related rights AI & LA Design Ltd., registration No. 40203324665, legal and postal address: Amalijas Street 12 – 6, LV-1002 Riga, Latvia, which, within the framework of its economic activity in accordance with Article 10 of the Consumer Rights Protection Law of the Republic of Latvia (CRPL), concludes this Distance Contract between the Buyer and the Seller, hereinafter the Contract.

1.2. Buyer – a person with a capability to place a Purchase Order in the online store. By registering himself or herself to make a purchase, the person confirms that he or she has the capacity and the right to shop in the Store.

1.3. The Contract shall be deemed concluded from the moment when the Buyer has placed a Purchase Order and made a payment for the Goods in accordance with these Terms.

1.4. The Seller is entitled to unilaterally amend and supplement the Terms of the Contract.
When the Buyer makes a purchase in the Store, the Terms of the Contract are applied that are valid at the time of placing the Purchase Order of the Goods.

1.5. The Seller has the right to restrict the use of the services of the Store without prior notice, if the Seller considers that the Buyer, by using the Store, may violate or violates the Terms of the Contract, tries to harm the Seller, the operation or the security of the Store, or any third parties.

1.6. All prices of design Goods on https://balticdesignstories.eu are indicated without Delivery Costs.

1.7. By placing a Purchase Order, the Buyer confirms that he or she has read this Contract and the Terms contained therein, which are known, understandable and the Buyer fully agrees with them. The Buyer undertakes to get acquainted with the Terms of the Contract every time he or she makes a Purchase Order.

2. Registration

2.1. In order to use https://balticdesignstories.eu and purchase the design Goods offered therein, the Buyer must provide the following his or her personal data: name, surname, e-mail address, address to which the Goods will be delivered, telephone number and other data important for delivery of Goods. The authorised representative of a legal entity chooses to fill in the information as a legal entity by indicating its name, registration number, e-mail address, address to which the Goods will be delivered, telephone number and other data important for the delivery of Goods.

2.2. The Buyer is responsible for ensuring that the information provided is accurate, correct, and complete. If the data of the Buyer changes, the Buyer must notify the Store immediately.
In no event shall the Seller be liable for any loss incurred by the Buyer or third parties as a result of incorrect or incomplete data provided by the Buyer (or failure to change or supplement this data).

2.3. The Buyer has the right to change, to supplement the data or to cancel his or her registration at any time.

2.4. The personal data provided by the Buyer will be processed in compliance with the laws
and regulations of the Republic of Latvia governing the processing and protection of personal data. When processing and storing the personal data of the Buyer, the Seller will use organisational and technical means that ensure the protection of personal data from accidental disclosure, exchange, or other illegal data processing.

2.5. If the Buyer uses the services of the https://balticdesignstories.eu store, it is considered that the Buyer agrees to the processing of his or her personal data and confirms that the information and personal data provided are correct and true. By agreeing to the Terms of the Contract, the Buyer grants the Seller, as the controller of personal data for the purposes mentioned in the Terms, the right to select, store, systematise, use and in any other way process these personal data which the Buyer has provided directly or indirectly using the services of the Store.

2.6. The personal data of the Buyer may be used for direct marketing purposes only with a written consent from the Buyer and the personal data provided may only be used by the Seller and its partners in administration of https://balticdesignstories.eu, delivery of Goods and other services related to the execution of the Purchase Order of the Buyer. The Seller undertakes not to disclose the personal data of the Buyer to third parties, except to the cooperation partners of the Seller as well as in cases specified in the legislation of the Republic of Latvia.

2.7. The Seller has the right to collect data not directly related to the Buyer as an individual. Such statistics are selected and processed in a way that do not reveal the identity or other personal data of the Buyer that could be used to identify the person.

3. Price, Delivery Costs and Payment

3.1. The Prices of Goods and services in a Purchase Order created at https://balticdesignstories.eu are indicated in euros (EUR). The Goods are sold to the Buyer at the price valid at the time of placing the Purchase Order at https://balticdesignstories.eu unless the parties have agreed otherwise.

3.2. The Buyer shall pay for the Goods and the Delivery Costs immediately after placing the Purchase Order by using VISA, Mastercard, PayPal payment systems.

3.3. The Seller, having notified the Buyer, is entitled to cancel the Purchase Order.

3.4. Delivery Costs are calculated at the time of ordering the Goods and added to the purchase invoice.

4. Assembly of Goods, Receiving and Delivery

4.1. The Seller assumes responsibility for the Purchase Order of the Buyer and ensures that it is fully executed but cannot guarantee it. If the ordered Goods are not in the Store or they are not in sufficient quantity, the Seller undertakes to inform the Buyer about it immediately.

4.2. If the Delivery of Goods is not possible due to the fault of the Buyer or circumstances depending on the Buyer, the Goods will not be delivered repeatedly (unless the Buyer pays repeatedly for the repeated Delivery of Goods) and the money paid for the Goods and Delivery will not be returned to the Buyer.

4.3. The Buyer agrees that in exceptional cases the Delivery of Goods may be delayed due to unforeseeable circumstances beyond control of the Seller. In this case, the Seller contacts the Buyer and agrees to a different Delivery time.

4.4. The Seller is released from liability for violation of the time of Delivery of Goods if the Goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or circumstances in control of the Buyer.

4.5. If the Buyer finds that the consignment does not contain the correct quantity of Goods
or the delivered Goods do not correspond to the Purchase Order made, and this is not indicated
in the delivery document, the Buyer must notify the Seller upon Delivery of the Goods.

5. Warranty of Goods and Expiration Date

5.1. The characteristics of all Goods offered on https://balticdesignstories.eu Store are generally indicated in the description of each item of Goods.

5.2. The Seller is not responsible for the fact that Goods listed on https://balticdesignstories.eu may not correspond to their actual size, shape, colour, and other parameters.

6. Cancellation, Exchange, and Return of Goods

6.1. If the Buyer considers and decides to waive the purchase, the Law on Consumer Rights Protection of the Republic of Latvia (CRPL) and the regulatory regulations of the Cabinet of Ministers No. 255 “Regulations on Distance Contracts” (Cabinet Regulation No. 255) stipulate that the Buyer has the right to withdraw from the Distance Contract within fourteen (14) calendar days and return the Goods that have been purchased in the Store to the Seller. The period
for exercising the right of withdrawal runs from the date of receipt of the Goods. CRPL Article 12, Paragraph 6 stipulates that in case of withdrawal of Distance Contract of the purchase, “the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal”.

6.2. The Buyer assumes responsibility for maintaining the quality of Goods in the event of exercising the right of withdrawal. The Goods must be undamaged, having not lost their appearance (labels not removed or damaged, protective films not torn off, etc.) and must not have been used.
The Goods must be returned in their original packaging and in the same assembly. If the Goods are not fully assembled, are damaged, soiled or are not properly packaged, the Seller has the right not to accept the Goods, as well as not to return the money paid for the Goods by the Buyer.

6.3. https://balticdesignstories.eu reserves the right to refuse to accept Goods that are damaged, have lost their original visual appearance, are not in their complete assembly. To exercise the right of withdrawal, the Buyer shall send a withdrawal to the e-mail: shop@balticdesignstories.eu, indicating the number of the Purchase Order, the date on which the Goods were ordered, the title of the Goods and their price. The Buyer is obliged to return the Goods within seven (7) calendar days after sending the written withdrawal.

6.4. The Seller returns the amount of the price of Goods that have been returned by the Buyer using the right of withdrawal within seven (7) days after acceptance of the Goods. Expenses for the Return of Goods are borne by the Buyer (except for Goods that do not comply with the Terms of the Contract). When returning or exchanging high-quality Goods that correspond to the Purchase Order of the Buyer, the Delivery Costs are not refunded to the Buyer.

6.5. Complaints received regarding the quality of Goods will be resolved in accordance with the provisions of the Consumer Rights Protection Law of the Republic of Latvia (CRPL), in accordance with the regulatory regulations of the Cabinet of Ministers No. 631 “Procedures for Applying for and Considering a Consumer Claim for Goods or Services Not Conforming to the Provisions of the Contract” (Cabinet Regulation No. 631).

6.6. CRPL norms do not apply to cases when the Goods are purchased by legal entities.

6.7. The Store reserves the right not to service the Purchase Order if the Store fails to contact the Buyer by the phone number or e-mail address provided by the Buyer.

7. Exchange of Information

7.1. The Seller shall notice or otherwise contact the Buyer using the e-mail address or telephone number provided in the registration form of the Buyer or in the contact form filled in without prior registration.

7.2. The Buyer shall send all notices and questions using the means and addresses indicated in the «Contacts» section of https://balticdesignstories.eu.

8. Dispute Resolution Procedure

8.1. The relations between the Buyer and the Seller are regulated by these Terms as well as by the legislation of the Republic of Latvia.

8.2. In the event of loss, the contractor in fault shall indemnify the other contractor the direct loss in accordance with the legislation of the Republic of Latvia.

8.3. Disputes are first solved through negotiations. If no agreement is reached, the dispute shall be resolved in accordance with the legislation of the Republic of Latvia.
